Terms of Use

These Terms of Use (“Terms”) govern your access to and use of this website (the “Site”) operated by PocketFetch (“PocketFetch,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 13 years old to use the Site. By using the Site, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. License to use the Site

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial purposes. You agree not to:

  • Copy, modify, distribute, sell, or lease any part of the Site or its content;
  • Reverse engineer or attempt to extract the source code of the Site, except to the extent permitted by law;
  • Use automated means, such as bots or scrapers, to access or collect data from the Site without our permission;
  • Use the Site in any way that is unlawful, or that could damage, disable, overburden, or impair it;
  • Attempt to gain unauthorized access to any part of the Site, its systems, or its networks.

3. Our applications

Software applications we develop are distributed through third-party app stores and are governed by their own license terms and by the terms of the applicable app store. These Terms cover the Site only.

4. Intellectual property

The Site and its content—including text, graphics, logos, images, and software—are owned by PocketFetch or its licensors and are protected by intellectual-property laws. Except for the limited license above, no rights are granted to you. “PocketFetch” and related names and logos are our trademarks, and you may not use them without our prior written permission.

5. Your submissions

When you send us a message through the contact form, you agree not to submit any content that is unlawful, infringing, or defamatory, or that you do not have the right to share, and not to include sensitive personal information. You retain ownership of your submission, but you grant us a non-exclusive, royalty-free license to use it for the purpose of responding to and managing your inquiry. Please do not send us confidential ideas; submissions are not treated as confidential.

6. Third-party links and services

The Site may contain links to third-party websites and services that we do not control. We are not responsible for the content, policies, or practices of any third party, and providing a link does not imply endorsement.

7. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any information on it is accurate or complete.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PocketFetch AND ITS OWNERS AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless PocketFetch and its owners from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or your violation of these Terms.

10. Changes to the Site and Terms

We may modify or discontinue the Site, or update these Terms, at any time. When we update these Terms, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the Site will be resolved exclusively in the state or federal courts located in California, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us and attempt to resolve the dispute informally.

12. California consumer notice

Under California Civil Code section 1789.3, California users are entitled to the following notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

13. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms constitute the entire agreement between you and PocketFetch regarding the Site.
